APPROXIMATE VACANCIES OF STS [DCs] ON DATE. As per Indian Revenue Service (Customs & Central Excise) CIVIL LIST 2006 issued by the Department of Revenue, Ministry of Finance, Government of India, there are 357 Deputy Commissioners in the list. Out of which 28 were promoted as Joint Commissioners vide the latest promotion order No. 215/2006 dated 13.10.2006 and 274 posts are vacant as per worksheet.

This application is filed by the applicant for a direction to the respondents to promote him to the grade of Senior Time Scale (Deputy Commissioner) with effect from 1.10.2006.
2. The applicant was promoted as Assistant Commissione JTS from Superintendent of Central Excise on 1.10.2002 and his name was found place in 2006 Civil List vide Sl. No. 152 (ID No. 1739) published by the Government of India, Ministry of Finance, Department of Revenue. According to the applicant he is eligible to be promoted to STS ( Deputy Commissioner) with effect from 1.10.2006 on completion of four years of service as Assistant Commissione JTS. Ut us gus case that to non-convening of the DPC by the respondents, he has not been considered for promotion. The applicant also made a representation on 15.3.2007 to the second respondent to give promotion to STS with effect from the due date on completion of four years of service in the JTS grade before his retirement as he is due to retire on 30.4.2007. The applicant also relied on the judgement of this Tribunal in O.A. 189 of 1999 dated 15.11.1999 to consider his case for promotion to STS on completion of four years of service as JTS. Since he was not favoured with any reply to his representation, he has approached this Tribunal for the aforementioned relief.
3. The respondents have filed a reply statement. It is stated that the Board sent a letter dated 31.5.2007 stating that a proposal for promotion to the gradde of Deputy Commissioner who have completed 4 years of service in the grade of Assistant Commissioner of Customs and Central Excise, as on date is being initiated in the Board wherein around 700 officers' service recofrds are to be assessed. It is also stated that the applicant's name is also included and his suitability for promotion to the grade of Deputy Commissioner is to be assessed by the DPC, when convened.
4. We have heard the learned counsel for the applicant and the learned counsel for the respondent and perused the pleadings.
5. In view of the reply statement of the respondents that the applicant's name is also included along with other 700 officers for being assessed by the DPC as and when convened for promotion to STS, suffice it to direct the respondents to convene the DPC and the applicant if found suitable promote him to STS (Deputy Commissioner with effect from 1.10.2006. This exercise shall be carried out within a period of three months from the date of receipt of a copy of this order. With this direction, the O.A. is disposed of. No order as to costs.
